NOTICE OF RIGHT-OF-WAY AMENDMENT APPLICATION ALPINE DIESEL PIPELINE, ADL 415932 ACF TO KUUKPIK PAD REROUTE The Alaska Department of Natural Resources (DNR), pursuant to Alaska Statute (AS) 38.35.070, hereby gives notice that ConocoPhillips Company (CPC) submitted a request to amend the Alpine Diesel Pipeline (ADP) Right-of-Way (ROW) Lease, ADL 415932, to add additional lands to reroute the ADP from its current termination point at the Alpine Central Facility (ACF) to the Kuukpik Pad. The proposed reroute crosses entirely over Kuukpik Corporation-owned lands except for state-owned lands beneath the Colville River's Nechelik (Nigliq) and Nigliagvik channels. The project consists of installing new piping on existing bridge infrastructure at the channels. The proposed amendment will allow for a temporary discontinuation of use for the unused ADP pipe along the original route to ACF, which would remain in the ADP ROW Lease. The project area is located approximately 61 miles west of Prudhoe Bay, and approximately 5 miles northwest of the Village of Nuiqsut. The ROW addition for the ADP at the Nechelik (Nigliq) Channel crossing lies below the ordinary high water line (OHW) within the SW1/4 of Section 13, Township 11 North, Range 4 East, Umiat Meridian; containing approximately four (4) acres for the proposed construction area. The ROW addition for the ADP at the Nigliagvik Channel crossing lies below OHW within the SE1/4 of Section 16, Township 11 North, Range 4 East, Umiat Meridian; containing approximately one (1) acre for the proposed construction; for a total of approximately five (5) acres. (a) An applicant or competing applicant or a person who has direct financial interest affected by the lease who raises objections within 60 days of the publication of notice under AS 38.35.070 are the only persons with standing to seek judicial review of a decision of the commissioner under AS 38.35.100. (b) The only grounds for judicial review of a decision of the commissioner are (1) failure to follow the procedures set out in this chapter; or (2) abuse of discretion so capricious, arbitrary, or confiscatory as to constitute a denial of due process.
